- Upload malicious software, harmful code, or fraudulent materials.
- Misrepresent your identity or authority to place an order.
- Use website content without authorization where permission is required.
- Submit artwork or other material that infringes another person's legal rights.

3. Intellectual Property
Unless otherwise stated, the website and its original content, including text, graphics, photographs, illustrations, logos, layouts, icons, product descriptions, design elements, software, and other materials, belong to USA Custom Embroidered Patches or are used under appropriate authorization.
Website content may be protected by copyright, trademark, and other intellectual-property laws.
You may view the website for personal or legitimate business purposes. You may not reproduce, republish, distribute, modify, sell, commercially exploit, or create derivative works from protected website content without prior authorization.
Nothing in these Terms transfers ownership of USA Custom Embroidered Patches' intellectual property to you.
4. Customer Artwork and Submitted Materials
Customers may submit logos, photographs, illustrations, sketches, text, brand assets, reference images, physical samples, or other materials for quotation, digitization, design, and patch production.
By submitting material to us, you represent and warrant that:
- You own the material or have permission to use it.
- You have the legal right to authorize its reproduction.
- Production of the requested design will not knowingly infringe another party's copyright, trademark, publicity right, or other intellectual-property right.
- The information you provide regarding the design and its intended use is accurate.
You retain ownership of intellectual property that lawfully belongs to you.
You grant USA Custom Embroidered Patches a limited right to use submitted material as reasonably necessary to prepare quotations, create mockups, digitize artwork, manufacture your order, communicate with you, perform quality control, and otherwise fulfill the requested service.
We may decline artwork or orders that we reasonably believe could violate applicable law, intellectual-property rights, or our business policies.
Unless separately authorized, submitting artwork to us does not transfer ownership of that artwork to USA Custom Embroidered Patches.
5. Product Information and Custom Manufacturing
We make reasonable efforts to present product information, patch types, materials, colors, dimensions, backing options, photographs, and examples accurately.
Custom patches are manufactured products, and minor variations may occur between digital representations and physical products.
Possible production variations may include small differences in:
- Thread appearance
- Fabric texture
- Color appearance
- Stitch placement
- Border thickness
- Finished dimensions
- Material characteristics
- Backing appearance
- Positioning of very small design details
Computer monitors, mobile displays, photography, lighting, and digital color profiles can also display colors differently from physical thread or material.
Where precise color matching is important, customers should provide recognized color references such as Pantone numbers or other requested specifications before approving the design.
Product images appearing on our website may represent previous work, examples, samples, or available styles and should not automatically be interpreted as an exact representation of every custom order.
6. Quotes, Pricing, Orders and Payment
Prices for custom patches can vary according to factors including:
- Patch size
- Patch type
- Quantity
- Embroidery coverage
- Number of colors
- Materials
- Backing
- Border type
- Design complexity
- Specialty features
- Production requirements
- Shipping method
- Rush requirements
Website pricing may be used as a general pricing reference where applicable. A custom quotation may be required for designs, dimensions, materials, quantities, or specifications that fall outside published pricing.
A quote does not constitute acceptance of an order until the required specifications have been confirmed and the order has been accepted by USA Custom Embroidered Patches.
We reserve the right to correct pricing, typographical, calculation, or quotation errors discovered before production begins.
Payment requirements will be communicated during the ordering process. Production generally begins after the required design approval and payment conditions have been completed.
Orders may be refused or cancelled before production when payment cannot be verified, required information is missing, the requested product cannot reasonably be manufactured, or the order would violate these Terms.
7. Digital Mockups, Revisions and Customer Approval
USA Custom Embroidered Patches may prepare a digital mockup or production-ready representation based on customer artwork and specifications.
The customer is responsible for reviewing the proof carefully before approval.
Before approving a design, please check:
- Spelling
- Names
- Numbers and dates
- Dimensions
- Patch shape
- Thread and material colors
- Artwork placement
- Border style
- Backing selection
- Quantity
- Other project specifications
Design revisions may be requested before final approval according to the service terms applicable to the order.
Once you approve a final proof, that approval authorizes us to manufacture the order according to the approved specifications.
USA Custom Embroidered Patches is generally not responsible for customer-supplied errors that were visible in an approved proof, including misspellings, incorrect dates, wrong numbers, or artwork elements specifically approved by the customer.
Changes requested after approval may require production to stop, restart, or be modified. Additional charges or revised delivery estimates may apply depending on the stage of production.
8. Production Times
Published turnaround periods are estimates rather than guarantees unless a guaranteed deadline has been expressly agreed to in writing.
Standard production is generally estimated from the point at which the required artwork has been approved and applicable payment requirements have been satisfied.
Production time may be affected by:
- Order quantity
- Design complexity
- Specialty materials
- Custom colors
- Large dimensions
- Multiple revisions
- Customer approval delays
- Rush periods
- Equipment availability
- Supply interruptions
- Circumstances outside our reasonable control
Rush production may be available for qualifying orders. Availability and timing should be confirmed before relying on a rush deadline.
Shipping transit time is separate from production time unless expressly stated otherwise.
9. Shipping and Delivery
We ship orders using available shipping and logistics providers and may provide tracking information where available.
Shipping times depend on factors such as destination, carrier service, weather, holidays, transportation conditions, and other circumstances outside our direct control.
Estimated delivery dates are not guaranteed unless a specific guaranteed shipping service has been separately arranged.
Customers are responsible for providing a complete and accurate delivery address before shipment.
USA Custom Embroidered Patches is not responsible for delivery problems caused by incorrect or incomplete address information supplied by the customer.
If a shipment appears lost, damaged, or materially delayed, please contact us so we can review the available tracking information and assist with the appropriate next steps.
Signature confirmation or expedited shipping may be available for qualifying orders.
10. Returns, Defects and Replacements
Because our patches are manufactured according to individual customer designs and specifications, custom products are generally not suitable for conventional change-of-mind returns after production.
If an order arrives with a manufacturing defect, incorrect specifications attributable to our production, or another verified quality issue, contact us promptly with your order information and clear photographs showing the concern.
Where we determine that a product does not reasonably match the approved specifications or our applicable quality standards, we may provide an appropriate remedy, which may include replacement of the affected products at no additional product cost.
Issues resulting from specifications approved by the customer generally do not qualify as manufacturing defects.
Examples may include:
- Customer-approved spelling errors
- Customer-approved incorrect numbers or dates
- An approved size that later proves unsuitable for the customer's intended garment
- A backing type selected by the customer that is unsuitable for an unreported fabric
- Color expectations based only on an uncalibrated digital screen when the physical product reasonably reflects the approved thread selection
- Damage caused after delivery through improper application, washing, storage, alteration, or use
We may request photographs, video, samples, packaging, or other reasonable evidence before determining the appropriate resolution.
11. Refunds and Order Cancellations
Custom patch orders involve design preparation, digitization, materials, production scheduling, and manufacturing specifically for an individual customer.
For this reason, cancellation eligibility depends on the stage reached by the order.
Customers wishing to cancel or change an order should contact us as soon as possible.
If production has not begun, we will review whether the order can be cancelled or adjusted. If design, material procurement, digitization, setup, or manufacturing work has already been performed, some costs may be non-refundable.
Once custom products have entered or completed production following customer approval, refunds for change of mind may not be available.
Where a refund is approved, it will normally be returned using the original payment method where reasonably possible.
Nothing in this section limits rights that cannot legally be excluded under applicable consumer-protection laws.
12. Application and Use of Patches
Customers are responsible for selecting a backing and attachment method suitable for their intended garment, uniform, hat, bag, equipment, or other surface.
Heat-sensitive fabrics, waterproof materials, coated textiles, leather, nylon, polyester, and specialty garments may require specific application methods.
Before applying an iron-on or heat-seal patch, customers should review the care instructions for the receiving garment and the application instructions provided for the patch.
USA Custom Embroidered Patches is not responsible for damage caused by incorrect heat settings, unsuitable fabrics, improper sewing, incorrect adhesives, improper washing, unauthorized alterations, or installation methods that do not follow appropriate instructions.
If you are uncertain whether a patch backing is suitable for a particular material, contact us before application.
13. Privacy Policy
Your privacy is important to us.
Information collected through quote forms, artwork submissions, communications, orders, website interactions, and related services is handled according to our Privacy Policy.
Our Privacy Policy explains the types of information we may collect, why we collect it, how it may be used or shared, applicable retention practices, cookies and tracking technologies, and privacy rights that may be available to customers.
By using the website and our services, you acknowledge our Privacy Policy as applicable to your use of the Service.
14. Disclaimer and Limitation of Liability
We make reasonable efforts to maintain an accurate, secure, and functional website and to provide products consistent with approved specifications.
To the fullest extent permitted by applicable law, however, the website and information made available through it are provided without guarantees that the website will always operate without interruption, errors, delays, or technical problems.
We do not guarantee that every browser, device, network, or third-party service will operate without interruption.
To the fullest extent permitted by law, USA Custom Embroidered Patches will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the website, inability to access the website, customer misuse of a product, or circumstances outside our reasonable control.
Where liability cannot legally be excluded, it will be limited only to the extent permitted by applicable law.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
15. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless USA Custom Embroidered Patches and its officers, employees, contractors, suppliers, agents, and service providers against third-party claims, losses, liabilities, damages, and reasonable costs arising from:
- Artwork or materials submitted by you that infringe another person's rights.
- Your unauthorized use of another party's logo, trademark, copyrighted work, photograph, or design.
- Your misuse of the website or products.
- Your material violation of these Terms.
- False representations concerning your authority to reproduce submitted artwork.
This section does not require you to indemnify USA Custom Embroidered Patches for claims arising solely from our own unlawful conduct where such liability cannot legally be transferred.
16. Governing Law, Changes, Severability and Entire Agreement
Governing Law
These Terms and your use of the website will be governed by applicable laws of the United States and, subject to confirmation of the Company's legal jurisdiction, applicable state law.
Any mandatory rights available to consumers under applicable law remain unaffected.
Changes to These Terms
We may update these Terms & Conditions from time to time to reflect changes to our products, services, website, business practices, or legal requirements.
The current version will be published on this page with an updated revision date.
Continued use of the website after revised Terms become effective constitutes acceptance of those Terms to the extent permitted by law.
Severability
If any provision of these Terms is held to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
Any unenforceable provision may be interpreted or modified only to the extent necessary to make it enforceable while preserving its intended purpose where legally possible.
Entire Agreement
These Terms, together with the Privacy Policy, applicable quotation, approved proof, invoice, and any other written terms expressly incorporated into an order, constitute the applicable agreement regarding your use of our website and services.
If specific written terms included in an accepted quotation or order conflict with general website terms, the more specific terms applicable to that transaction may control to the extent stated in those documents.
